1. Acceptance of Terms

By contacting, scheduling services with, or otherwise engaging NEXTLEVEL Landscape & Tree Care (“Company,” “we,” “our,” or “us”), including through our AI-powered receptionist system, you agree to these Terms of Service. If you do not agree, do not use our services.

2. AI Receptionist Disclosure

Our business uses an AI-powered virtual receptionist system (via Jobber) to:

• Answer calls
• Respond to text messages
• Schedule appointments
• Collect customer information
• Provide general service information

This system may record and process communications to improve service quality. The AI system is not a licensed arborist and does not provide professional tree risk assessments or binding quotes. All estimates and service confirmations are subject to human review.

3. Services Provided

We provide professional tree care and landscape services including but not limited to:

• Tree trimming
• Tree removal
• Stump grinding
• Tree planting
• Emergency tree services
• General landscape maintenance

All services are subject to site inspection and approval.

4. Estimates & Pricing

• Estimates provided by phone, text, or the AI system are preliminary.
• Final pricing may change after an on-site inspection.
• Written estimates are valid for 14 days unless otherwise stated.
• Additional work requested on-site may incur added charges.

5. Scheduling & Cancellations

Appointments scheduled via phone, AI system, text, or website are subject to availability.

Cancellation Policy:

• 24-hour notice is required to cancel or reschedule.
• Failure to provide notice may result in a service fee.

Emergency services may be subject to premium pricing.

6. Property Access & Customer Responsibilities

Customer agrees to:

• Provide safe and reasonable access to the property
• Secure pets
• Disclose underground utilities, irrigation, septic systems, or hazards

We are not responsible for hidden underground utilities, pre-existing structural damage, or damage caused by undisclosed hazards.

7. Tree Risk & Limitation of Liability

Tree work involves inherent risks. While we take all reasonable precautions, we are not liable for natural shifting, cracking, or minor landscape disturbance. We are not responsible for damage resulting from tree failure caused by undisclosed decay or structural defects.

To the extent permitted by law, liability is limited to the total amount paid for services performed.

8. Payment Terms

• Payment is due upon completion of service unless otherwise agreed in writing.
• Late payments may incur fees.
• We reserve the right to file mechanic’s liens for nonpayment as allowed under Arizona law.

9. Communication Consent (SMS & Calls)

By contacting us or providing your phone number, you consent to receive calls, text messages, automated appointment reminders, and service updates. Standard carrier rates may apply.

Calls and messages handled by our AI receptionist system may be recorded for quality assurance, training, and documentation purposes.

11. Insurance

NEXTLEVEL Landscape & Tree Care is properly insured for tree care operations. Proof of insurance is available upon request.

12. Governing Law

These Terms shall be governed by the laws of the State of Arizona. Any disputes shall be resolved in Yuma County, Arizona.

13. Changes to Terms

We reserve the right to update these Terms at any time. Updates will be posted on our website.
